What is the California Penal Code?

Each section of the Penal Code is identified by a specific number and letter, such as Penal Code 273.5 PC, which refers to domestic violence, or Penal Code 23152 PC, which addresses driving under the influence (DUI).

Note that vehicular crimes are covered in the Vehicle Code, and many drug crimes are covered in the Health and Safety Code.

How is the California Penal Code Organized?

The California Penal Code is systematically organized to cover every aspect of criminal law, from definitions of crimes to the procedures for handling cases in court. The code is divided into six main parts, each addressing different stages of the criminal process:

  2. Criminal procedure (681 – 1620)

How Does Criminal Procedure Work?

According to Part 2 of the California Penal Code, the criminal procedure in California outlines the steps the legal system follows when someone is charged with a crime. These procedures ensure that individuals are given a fair trial and that justice is served. The major steps of the criminal process are as follows:

  • Arrest: Law enforcement officers have the authority to arrest a person when they have probable cause to believe the individual has committed a crime.

  • Arraignment: After the arrest, the accused must be brought before a judge for an arraignment, where they are formally charged and asked to enter a plea of guilty, not guilty, or no contest.

  • Preliminary Hearing: In felony cases, the court holds a preliminary hearing to determine whether there is enough evidence for the case to go to trial.
